Last night my Youtube (StereoStef) account was TERMINATED.
YouTube account StereoStef has been terminated because we received multiple third-party notifications of copyright infringement from claimants including:
· Dick Clark Productions, Inc.
· Twentieth Century Fox Film Corporation
· Twentieth Century Fox Film Corporation
I have been a youtube member for 5 years and had over 400 videos. The videos were all created by ME. They were all fun experiences with memories of my family, friends, music, and entertainment. When I first discovered YT, I thought it was the greatest site ever invented, and still do. I wasn’t on this site to make money; all of the content I uploaded was mine. There were several videos that had music in the background and I would give the artist credit, also stating, “NO COPYRIGHT INFRINGMENT.”
For my account to be TERMINATED seems UNFAIR!
The “3 strikes you’re out” deal is reasonable, especially with some of the content people upload but is there any way I can appeal this? I feel like such a fool, a gleek fool, because the 3 accounts were all glee related. Did I mention I was GLEEK OF THE WEEK (4/26/11)? Can I plead insanity? My obsession with glee got my YT account terminated.
I can recall the violation of the “Dick Clark Productions, Inc.” and I can see why that was removed. It was glee related. I filmed a few seconds of glee receiving an award on tv and reactions of the people in the room. Yes I filmed something else getting filmed on the television. After the video was removed and I received my notice, I read the COPYRIGHT TIPS. I acknowledged my wrong doing in regards to the infringement.
I hadn’t uploaded a video in a long time. Yesterday I uploaded 2 videos from the GLEE LIVE concert. Something I’ve been regretting all night and morning. Both videos are less than 2 mins and one is even less than 1 minute. I wanted to share them with other gleeks around the world that couldn’t attend a show. It is an amazing performance! I do believe that every fan should see the concert. I know that Latin America has been sending out online petitions to get the tour over there. This is the second time the tour didn’t schedule there. I just wanted to share the glee love. I am ecstatic that there will be a GLEE CONCERT 3D FILM coming out in August and I apologize if my clips of 128 seconds were a violation of Twentieth Century Fox Film Corporation.
Please note that under Section 512(f) of the Copyright Act, any person who knowingly materially misrepresents that material was disabled due to mistake or misidentification may be liable for damages.
I am just a mere fan and my videos that contained INFRINGMENT were due to me, Stephanie Chavez, being stupid and not knowing the complete laws. I honestly didn’t think I was doing anything wrong with sharing the glee material. I would have never purposely done anything to violate my favorite television show, GLEE. I respect the program and Fox. I love the Fox Film Corporation and would never try to take credit for something that wasn’t mine. Yes, I filmed it. No, I didn’t know I wasn’t allowed to film it, let alone upload it. I didn’t upload episodes of glee, or glee material that wasn’t mine. In this sense, it was mine because I recorded it but I will never make that gleeky mistake again.
I know you probably get people begging for another chance…well….I AM one of them. Please Please Please REINSTATE my YT accountSTEREOSTEF. I know that people say they will never do it again and then turn around and repeat their mistakes but I PROMISE that I’m not one of those people. I would sign some kind of form stating that I would never upload a video to the STEREOSTEF account again, if that’s what it would take.
When YT terminated my account, an arrow was shot through my heart. That was YT deleting my memories; most of the memories that I would probably never see again, due to computer crashes and lost files. I share my videos with friends and family all over the world. I am beyond depressed that my visual memories have been cut out of the internet. This was mytube! I just want my previous videos back. I’ve worked so hard on them.
I’ve been to concerts where they have postings saying, “No recording allowed!” The GLEE concert wasn’t one of them. I even asked a couple of workers, at the show, if filming clips were allowed and they said yes. I know, they have nothing to do with this violation but that’s just the type of person I am, I want to make sure I abide by the rules. I searched through YT and saw videos from the tour and thought it was fine. If I waited another day, I would’ve seen that they were removed and would have never attempted to upload the videos!
I would have been grateful to have an account suspension for a while as opposed to terminating. What can I do? Please help me. I have been a loyal user all these years. I’m hoping that you will take that into consideration. Try out a different equation strategy: the number of videos uploaded, times years, divided by the number of violations, times years. Have a little heart, from one fan to another.
Sincerely,
Stephanie A. Chavez
attached below is the 2 videos that were due to infringement.
